When you find a section you like, it is worth looking beyond the boundary lines. The title may include covenants or other restrictions that affect what you can build and how you can use the property.
Understanding those details early helps you develop the design with the right information in front of you.
Start with the actual documents and ask your solicitor to explain what applies.
Read the title and related documents
Ask which covenants, easements and other interests are recorded, and what they mean for your plans. LINZ's record of title information explains the role of the title.
Do not assume the restrictions are the same as another property nearby. Your solicitor should review the specific documents for the section you are considering.
Bring the rules into the design conversation
Covenants may address things such as exterior appearance, materials, fencing or other aspects of the property. The details depend on the documents.
Share them with your designer and builder before settling on the home. It is easier to explore a compliant option early than revisit a design after important decisions have been made.
Check whether another approval is needed
Ask whether there is a separate design review or approval process, who manages it and what information is required.
Covenant requirements and council planning or building requirements are separate. Satisfying one does not automatically establish that all the others are met.
Include any relevant responsibilities and timing in your project discussion.
Think about future plans too
If you hope to add a shed, change a fence, use the property differently or make other alterations later, raise those ideas with your solicitor now.
Avoid assuming a future change will be allowed simply because it fits within the section. Check the restrictions alongside the relevant council requirements.
What if your idea does not fit a covenant?
Ask your solicitor about the legal position and any available process before proceeding. Do not rely on an informal suggestion that a rule will be ignored or automatically changed.
Your designer may be able to explore another way to meet your needs within the applicable requirements.
Keep everyone working from the same information
Bring the title and relevant documents into the project file, and confirm which approvals remain outstanding. Our section buying checklist helps you gather the wider property information.
Talk with your Classic Builders team about the section and home you have in mind. The documents help us understand the questions to work through with you and your advisers.
